Poolvillas Additional General Booking Terms and Conditions

Introduction

These General Booking Terms and Conditions apply in addition to the ANVR Travel Terms and Conditions.

1. Booking fee and Calamity Fund

€ 30 Booking fee en € 2.50 Calamity Fund will be charged per booking. US$ 40 Booking fee and US$ 3.00 (European citizens only) for bookings in our Bali villas. These costs must be paid together with the down payment and are non-refundable when the booking is cancelled.

2. Prices and (down) Payment

2.1. After the booking is made, Poolvillas must have received the down payment of 30% of the rent amount, as well as the Booking fee and Calamity Fund, within 3 working days to secure the reservation. As well as any extras of which is indicated on the reservation form that they must be paid upon booking. For our Bali villas, the down payment is 50% of the rent.

2.2. The final balance must be paid no later than 6 (six) weeks before the arrival of the client’s arrival date.

2.3. If a booking is made within 6 (six) weeks before arrival, the full rent amount together with any specified extras is due immediately upon reservation.

3. Damage deposit

3.1. You should note that the accommodation provider may require a deposit, depending on the accommodation and the destination. The actual amount is indicated on the first page of the reservation form. The deposit is payable upon arrival or transferred onto bank account a week before your arrival, depending on the accommodation provider. The method of payment also depends on the accommodation provider; by credit card, bank transfer in advance or cash on the spot. This information can be found on the voucher.

3.2. The Damage deposit will be returned in full within 7 days after your departure.

3.3. In the event of damage and/or loss of the rented property, and/or circumstances for which the tenant is to blame, the total incurred damage will be deducted from the deposit. In all instances where the costs of damage and/or loss of the rented property or the damage suffered by the accommodation provider exceed the paid deposit the tenant must immediately pay the excess to the accommodation provider. All instances of breakage, loss and/or damages must be reported immediately to the accommodation provider and paid for.

3.4. If, on arrival at the property, you find any type of irregularity, we request that you inform the local contact person, specified on your voucher, within 24 hours so that a solution can be found and deductions for breakages that are not your responsibility can be prevented.

4. Cancellation

4.1. At any time the tenant may cancel the services requested and contracted with the right to a refund of payments made with the exception of the indemnity payments as detailed below:

  • cancellation up until 42 days before arrival: the down payment of 30%;
  • cancellation between 42 and 30 days before arrival: 80% of total rent amount;
  • cancellation as of 30 days or less before arrival: 100% of total rent amount.

For bookings in our Bali villas, the following cancellation policy applies:

  • cancellation up until 45 days before arrival: the down payment of 50%;
  • cancellation between 45 and 30 days before arrival: 80% of total rent amount;
  • cancellation as of 30 days before arrival: 100% of total rent amount.

For bookings in our Mallorca villas, the following cancellation policy applies:

  • cancellation up until 70 days before arrival: the down payment of 30%;
  • cancellation between 70 and 30 days before arrival: 60% of total rent amount;
  • cancellation as of 30 days before arrival: 100% of total rent amount.

4.2. Poolvillas should be informed of any cancellation immediately by email or fax. Cancellations outside office hours are deemed to have been made on the following working day.

4.3. Deposits will be refunded only if the booking cannot be honoured due to a cause attributable to the accommodation provider or Poolvillas.

4.4. If the tenant has to cancel the booking, he can request Poolvillas to replace him/her with another person. (see Article 8 of the ANVR Travel Terms and Conditions). Cancellation or a request for substitution is only possible during office hours; from Monday / Friday from 09.00 to 17.00.

5. Liability

5.1. The tenant booking the accommodation and who enters into the reservation agreement for or jointly on behalf of other occupants will be jointly and severally liable for the total rent and for damage caused by acts by him and all others present with him in the rented accommodation.

5.2. Poolvillas will not accept bookings for groups of customers under 21 years. This means that at least one person (the tenant of the booking) must be minimum 21 years old. Therefore it is a must, to inform us about the age to confirm.

5.3. Poolvillas rents to family groups and responsible adults only; absolutely no house parties or functions such as weddings are allowed without advance written permission from Poolvillas. Guests shall be sufficiently quiet and peaceful so as not to disturb other residents of the neighbourhood.

5.4. Under no circumstances whatsoever will the accommodation provider or Poolvillas be responsible for any loss or loss of value and/or damage to property of the tenant and his co-occupants caused by incorrect use of the rented property. If the tenant incurs damage due to deficiencies in the rented property, any liability on the part of landlord will be limited to the amount of the rent. Damage resulting from non-fulfilment by the landlord will be subject to the compensation provided for by law. Landlord will not be liable for any other damage.

6. Documents

Before your arrival Poolvillas shall provide you with the information you need about the rented property and locale area. The tenant is personally responsible to be in possession upon arrival of all the necessary documents needed for the length of his stay. The tenant must therefore check in time whether the previously obtained information is still correct. Poolvillas can be of assistance. We recommend our international customers, to obtain information in advance on any necessary visas or other official documents at the relevant embassy and/or tourist office.

7. Check-in and Check-out

7.1. The time at which the accommodation will be available on the day of arrival, depends on the region and/or accommodation provider and can be found on our website and on the voucher. 7.2. It is vital that we are sent flight details or expected arrival and departure times in order to facilitate a smooth check-in and check-out. It does not however guarantee an early check-in or a later departure from the property.

7.3. For clients who arrive outside office hours, we request that you inform us as soon as possible so that we can give you arrival information, such as: directions to the property and instructions for key collection. Ensure that the reservation is 100% paid and that you have facilitated the payment of the deposit.

8. Construction work

Nearly all our accommodations are private properties that belong to individual owners and are generally located in spacious residential or rural areas. So construction work may occasionally occur nearby. This work may be carried out by home owners or contractors and/or public institutions, with whom we have no relationship whatsoever and over whom we cannot exert any control. Neither the accommodation provider, nor Poolvillas can be held liable for inconvenience caused by any construction work not commissioned by the accommodation provider himself.

9. Occupancy

9.1. Each property is prepared for a determined number of occupants. It is not permitted in any event to exceed the maximum occupancy of the property as advertised. It is the responsibility of the client at all times to ensure that the number of people occupying the property matches the number if people on the reservation form. Failure to comply with this rule will result in the payment of an occupancy supplement or can even result in eviction without refund.

9.2. It is the responsibility of the client to deposit garbage in the correct containers, which are normally situated on the nearest main road. Please take into account that many properties are in rural locations and leftover food can attract cats, insects and other undesirable creatures. On departure there should be no rubbish bags left in the property. Failure to comply with this carries a penalty of deduction from your deposit which can vary between € 40 and € 100.

9.3. Garden and pool need to be maintained regularly, meaning that you can expect a visit from a gardener and/or pool man during you stay. If you want to know the exact time of their visit, please ask the Keyholder upon your arrival. Please note that it is strictly forbidden for tenants to operate the garden watering systems and/or pool pump nstallations.

10. Bed linen and towels

Bed linen and towels are usually included in the rental price. To verify if this is the case, you can view the property details on our website. In some cases you may be required to exchange the bed linen and towels at the key holder’s reception desk after each week of your stay.

Bear in mind that you can never have too many towels, especially when having a private pool in front of your doorstep. We therefore advice you to take a number of towels with you or to rent an extra set.

11. Location description

Poolvillas tries to capture and control the description of your destination as best as possible, but can however not take responsibility for this. We also try to give an indication of the distances to shops, restaurants, beach, etc. as best as possible. However, Poolvillas cannot accept liability for arisen incremental changes.

12. Satellite-tv and cable-tv

Where descriptions refer to satellite-tv or cable-tv, it does not automatically mean that reception includes the tv-channels of your home country. The mostly foreign owners have decoders that are not always suitable for receiving all international programs.

13. Unwanted visitors

In countries with a warmer climate, you may encounter for example ants, beetles and other insects in your accommodation. Most of the time, using an insecticide is enough to get rid of that problem, but also the secure storage and disposal of food helps. But you can also contact the Keyholder. They will do their utmost to rid you of unwanted visitors.

14. Water, Electricity and Internet

14.1. Interruptions to water, electricity supplies and Internet connections are not uncommon in some countries. Neither your accommodation provider nor Poolvillas can be held liable for any inconvenience or damage incurred through such circumstances.

14.2. Water: In most warm countries, water is a scarce commodity and stocking up happens in 2 ways: via well water or desalination. The well water doesn’t reach enough capacity and the desalinations are insufficient; as a result having salty water and not covering the needs of the region. For your own good and for the local people, take care of the water and please don’t waste it!

14.3. Wi-Fi & Internet: Not everywhere, Internet is well organised. Most holiday homes in countries as Portugal, Spain, Italy, but also on Bali, there isn’t a house that has ADSL, let alone optical fibre. Each Wi-Fi usually has a maximum of 20 GB for the entire month. For this reason we kindly ask you to use it for surfing only or for sending e-mails. If you or your children use the WhatsApp calls, Skype, YouTube or you download any type of application, the monthly GB is going to be consumed in a week’s time and neither you nor the other clients of the same villa will be able to recharge more data, since the company doesn’t allow it. In such case we won’t be able to help you. There is simply not going to be anymore Wi-Fi.

14.4. Energy consumption: A mandatory surcharge may sometimes be applicable in certain seasons for properties with heating and/or air conditioning. For more detailed information and the amounts payable, please check the property details stated on our website, or contact us.

15. Pets

Most accommodation providers do not allow pets. You may keep a pet in or around the villa only with the explicit permission of Poolvillas stated on the reservation form and voucher. The accommodation provider may require extra mandatory final cleaning costs.

16. Sunscreen lotions

In the last year we have noticed a huge amount of body lotions, sunscreens and the latest generation of tanning oils which apparently help you to get tanned quicker. The downside is, that they contain substances that affect the good performance of the swimming pool and its engines and most of the time leaves persistent spots on the household linen, bathing suits and sun lounger mats.

Please be aware of this because when serious damage Is made, we are forced to make you responsible of any damage and the correspondent amount is going to be discounted from the deposit.
